【2022年改正電気通信事業法】外部送信規律(クッキー規制)の対象事業者は?

はじめに

2022年に成立した改正電気通信事業法(以下「改正法」といいます。)については、以前に、【2022年改正電気通信事業法】クッキー規制に関して事業者がとるべき対応は? で速報としてご紹介させて頂きました。
施行日(公布日(2022年6月17日)から1年以内)が近づくにつれ、改正法の詳細も明らかにになってきましたので、本コラムでは、改正法による外部送信規律(クッキー規制)の対象事業者についてご説明いたします。
なお、本コラムは2023年1月31日までに公表されている情報を基にしております。また、改正法のうち大規模な電気通信事業者を対象とする部分等は割愛しています。

改正法の対象事業者は?

改正法は、対象となる事業者を「電気通信事業者又は第三号事業を営む者(内容、利用者の範囲及び利用状況を勘案して利用者の利益に及ぼす影響が少なくないものとして総務省令で定める電気通信役務を提供する者に限る。)」(改正法27条の12柱書)としています。電気通信事業者は、既に届出済のはずですので、問題は「第三号事業者(略)」の範囲となります。

第三号事業者(利用者の利益に及ぼす影響が少なくない電気通信役務の提供者)とは?

第三号事業のうち、「利用者の利益に及ぼす影響が少なくない電気通信役務」は、以下のいずれかの電気通信役務のうち、ブラウザやアプリケーションを通じて提供されているものです(電気通信事業法施行規則第27条の2の27)。

  1. 利用者間のメッセージ媒介等(同条第1号) 例:メールサービス、ダイレクトメッセージサービス、参加者を限定した(宛先を指定した)会議が可能なweb会議システム等
  2. SNS、電子掲示版、動画共有サービス、オンラインショッピングモール等(同条第2号)
  3. オンライン検索サービス(同条第3号)
  4. ニュース配信、気象情報配信、動画配信、地図等の各種情報のオンライン提供(同条第4号)

よって、これらのサービスを提供している事業者は、これまで「電気通信事業者」として届出をしていなくても、改正法による外部送信規律(クッキー規制)の対象となります。
詳しくは、総務省の「外部送信規律」ウェブサイトをご確認ください。

他方で、ホームページを開設していても、それが電気通信事業ではない本来業務のPRのためのものである場合は、電気通信事業に該当せず改正法の規制対象外となります。

おわりに

以上のとおり、「電気通信事業者」と「第三号事業者(利用者の利益に及ぼす影響が少なくない電気通信役務の提供者)」が改正法の対象となり、外部送信規律(クッキー規制)への対応が必要となります。

<改正規則抜粋>
第二十二条の二の二十七(利用者の利益に及ぼす影響が少なくない電気通信役務)法第二十七条の十二の総務省令で定める電気通信役務は、次の各号のいずれかに該当する電気通信役務であつて、ブラウザその他のソフトウェア(利用者が使用するパーソナルコンピュータ、携帯電話端末又はこれらに類する端末機器においてオペレーティングシステムを通じて実行されるものに限る。次条において同じ。)により提供されるものとする。
一 他人の通信を媒介する電気通信役務
二 その記録媒体に情報を記録し、又はその送信装置に情報を入力する電気通信を利用者から受信し、これにより当該記録媒体に記録され、又は当該送信装置に入力された情報を不特定の利用者の求めに応じて送信する機能を有する電気通信設備を他人の通信の用に供する電気通信役務
三 入力された検索情報(検索により求める情報をいう。以下この号において同じ。)に対応して、当該検索情報が記録された全てのウェブページ(通常の方法により閲覧ができるものに限る。次条において同じ。)のドメイン名その他の所在に関する情報を出力する機能を有する電気通信設備を他人の通信の用に供する電気通信役務
四 前号に掲げるもののほか、不特定の利用者の求めに応じて情報を送信する機能を有する電気通信設備を他人の通信の用に供する電気通信役務であつて、不特定の利用者による情報の閲覧に供することを目的とするもの

[The Telecommunications Business Act (revised2022)] Which businesses are subject to the external transmission rules (cookie regulations)? 

Introduction
Regarding the Telecommunications Business Act (revised2022, “Revised Act”) , we introduced it as a preliminary report in ”What should businesses do about the cookie regulations in The Telecommunications Business Act (revised2022)”.

As the enforcement date (within one year from the promulgation date (June 17, 2022)) approaches, the details of the revised law are becoming clearer, and this column explains the businesses subject to the external transmission regulations (cookie regulations) under the revised law.

This column is based on information published by January 31, 2023. In addition, portions of the revised law that target large telecommunications businesses, etc. are omitted.

Which businesses are covered by the revised law?
The revised law defines the target business operators as “telecommunications carrier or a person operating “business of item (iii)*1(limited to those who provide telecommunications services specified in the applicable Ordinance of MIC as having a no less impact on the interests of users in consideration of the content, scope of users, and usage conditions)”. (Article 27-12, Pillar 1 of the Revised Law*2). Since telecommunications carrier should have already filed a notification, the issue is the scope of ” a person operating business of item (iii)”.

What is a person operating business of item (iii)?
Telecommunications services that have no less impact on the interests of users in business of item (iii) are any of the following telecommunications services that are provided through browsers or applications (Article 27-2-27 of the Enforcement Regulations of the Telecommunications Business Law)
1.Message mediation, etc. between users (Item 1 of the same article) e.g., e-mail services, direct message services, web conferencing systems that enable meetings with limited participants (by specifying the destination), etc.
2.SNS, electronic bulletin boards, video sharing services, online shopping malls, etc. (Item 2 of the same article)
3.Online search services (Item 3 of the same article)
4.Online provision of various types of information such as news distribution, weather information distribution, video distribution, maps, etc. (Item 4 of the same article)

Businesses that provide these services are subject to the external transmission regulations (cookie regulations) under the revised law, even if they have not previously filed a notification as a “telecommunications carrier.

For details, please refer to the “External Transmission Regulations” FAQ of the Ministry of Internal Affairs and Communications.

On the other hand, even if a website is established, if the website is not a telecommunications business but is used for PR purposes, it does not fall under the category of a telecommunications business and is not subject to the regulations of the revised law.

Conclusion
As described above, “telecommunications businesses” and ” a person operating business of item (iii) (limited to those who provide telecommunications services specified in the applicable Ordinance of MIC as having a no less impact on the interests of users in consideration of the content, scope of users, and usage conditions)” are subject to the revised law and must comply with the external transmission rules (cookie regulations).

The revised law is scheduled to be enforced by June 2023, so it is advisable for businesses that may be subject to the revised law to take action as soon as possible.
